Terms of Service

These Terms of Service (“Terms”) are an agreement between you and My Momentum LLC (“My Momentum,” “we,” “us”). By creating an account or using the MyMomentum app or website (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using MyMomentum you represent that you meet this requirement and that the information you provide is accurate.

2. What MyMomentum is — and what it isn’t

MyMomentum generates personalized self-hypnosis and meditation audio sessions based on prompts and preferences you provide. The Service is for relaxation, self-improvement, and stress management only. It is not a medical device, and it does not provide medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment. Using the Service does not create a clinician–patient, therapist–client, or any other professional relationship between you and My Momentum LLC. The Service is not a substitute for care from a licensed professional.

Do not use the Service while driving, operating heavy machinery, or in any situation requiring your full attention. Sessions intentionally induce deep relaxation and may cause drowsiness.

Please consult a licensed clinician before using the Service if you have or have ever had:epilepsy, a seizure disorder, photosensitivity, PTSD or complex trauma, dissociative disorders, psychosis or schizophrenia-spectrum conditions, bipolar disorder, severe depression or anxiety, an eating disorder, active substance use or withdrawal, a recent significant loss, or any other serious mental or physical health condition. If you are pregnant, talk with your OB or midwife before doing deep relaxation work.

The Service is not for emergencies. If you are experiencing a mental health crisis or thoughts of harming yourself or others, call or text 988 (in the US), or contact your local emergency services. The Service is designed to detect language suggesting crisis, self-harm, harm to others, active psychosis, or use by a minor, and will stop the session and surface support resources when it does.

AI-generated content. Sessions, suggested affirmations, and conversational replies are generated by AI based on your inputs and may occasionally be inaccurate, incomplete, or unexpected. Always review a session before relying on it. Do not rely on the Service for medical, legal, financial, or other professional advice.

3. Your account

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly at info@mymomentumworks.com if you suspect unauthorized access.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulation.
• Submit content that is harassing, hateful, sexually explicit, or that targets others.
• Attempt to instruct the AI to produce content related to harming yourself or others. The Service is designed to detect such language and stop the session.
• Attempt to reverse engineer, scrape, overload, or otherwise interfere with the Service.
• Resell, sublicense, or commercially redistribute generated sessions without our written permission.

5. Your content & license

You retain ownership of the topics, answers, notes, and recordings you submit (“Your Content”). You grant MyMomentum a limited, worldwide, royalty-free license to process Your Content solely to operate the Service for you — for example, to generate, store, and play back your sessions, and to maintain backups. We do not use Your Content to train AI models, and we do not share it for marketing.

6. AI-generated output

Sessions are generated by AI based on your inputs. Output may occasionally be imperfect, inaccurate, or unexpected. You are responsible for reviewing any session before relying on it. Subject to your compliance with these Terms, you may use sessions generated for your account for your own personal, non-commercial use.

7. Service availability & changes

We may modify, suspend, or discontinue parts of the Service at any time. We may also impose limits on features or storage, or change pricing in the future with reasonable notice.

7a. Payments, subscriptions & Paddle

Paid subscriptions and one-time purchases are processed by our Merchant of Record, Paddle.com, Inc. (“Paddle”). Paddle handles payment processing, billing, tax collection, invoicing, subscription management, cancellations, and refunds on our behalf. By making a purchase you also agree to Paddle’sBuyer Terms. Subscriptions automatically renew for the same term unless cancelled before the renewal date. You can manage or cancel your subscription through the customer portal or by contacting us.

Merchant of Record disclosure: Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

7b. Refunds

We offer a 30-day money-back guarantee. If you are not satisfied with your purchase, you can request a full refund within 30 days of your order date. Refunds are processed by Paddle. To request a refund, visit paddle.net or contact us at info@mymomentumworks.com.

8. Termination

You can delete your account at any time from Profile → Delete my account. We may suspend or terminate your access if you violate these Terms or use the Service in a way that harms others or the Service itself. Sections that by their nature should survive termination (ownership, disclaimers, liability limits, governing law) will survive.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. WE DO NOT WARRANT ANY PARTICULAR THERAPEUTIC, MEDICAL, OR EMOTIONAL OUTCOME FROM USING THE SERVICE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYMOMENTUM AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $100.

11. Indemnification

You agree to indemnify and hold harmless MyMomentum and its owner from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or your violation of these Terms.

12. Governing law & disputes

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Utah will have exclusive jurisdiction over any dispute arising from these Terms or the Service, and you consent to personal jurisdiction in those courts.

13. Changes to these Terms

We may update these Terms from time to time. We will update the “Effective” date and, for material changes, give reasonable notice in the app or by email. Continued use after changes take effect constitutes acceptance.
